Agreement to Terms

Welcome to Pacific Direct Express. These Terms and Conditions govern your use of our logistics, courier, and freight services across Asia, Europe, America, and worldwide. By accessing our website, booking shipments, or using any of our services, you agree to be bound by these terms in full.

If you disagree with any part of these terms, you must not use our services. We reserve the right to modify these terms at any time without prior notice. Continued use of our services after changes constitutes acceptance of the new terms.

These terms apply to all customers including individuals, businesses, e-commerce merchants, and corporate clients shipping domestically or internationally through Pacific Direct Express.

1. Service Description

Pacific Direct Express provides comprehensive logistics and courier services including:

  • Same-day and next-day delivery services across major cities worldwide
  • International freight shipping across Asia, Europe, and America
  • Real-time package tracking and monitoring
  • Warehousing and distribution solutions
  • Customs clearance and documentation assistance
  • Specialized handling for fragile, valuable, or temperature-sensitive items
  • E-commerce fulfillment and last-mile delivery

Service availability may vary by location, package type, and current operational conditions. We reserve the right to modify or discontinue services with reasonable notice.

2. Booking and Payment Terms

  • Booking Confirmation: All bookings are subject to availability and confirmation. We reserve the right to refuse any booking at our discretion.
  • Payment Requirements: Payment must be made in full before shipment collection unless credit terms have been pre-approved in writing.
  • Pricing: All prices are quoted in local currency and may vary based on weight, dimensions, destination, service type, and fuel surcharges.
  • Additional Charges: Additional fees may apply for remote area delivery, customs duties, taxes, storage, or special handling requirements.
  • Refunds: Refund requests must be submitted within 30 days of service completion. Refunds are subject to review and approval.
  • Currency: International shipments may be subject to currency conversion fees and exchange rate fluctuations.

3. Prohibited Items

For safety, legal, and regulatory reasons, the following items cannot be shipped through Pacific Direct Express:

  • Explosives, firearms, ammunition, and weapons of any kind
  • Flammable liquids, gases, and hazardous chemicals
  • Illegal drugs, narcotics, and controlled substances
  • Counterfeit goods and pirated materials
  • Live animals (except through specialized pet transport services)
  • Human remains or bodily fluids
  • Cash, currency, negotiable instruments, or precious metals above declared limits
  • Perishable food items requiring refrigeration (without special arrangement)
  • Items prohibited by local, national, or international law

Violation of these restrictions may result in shipment confiscation, legal action, and permanent service termination. Customers are responsible for ensuring compliance with all applicable laws.

4. Liability and Insurance

  • Basic Coverage: All shipments include basic liability coverage up to the declared value or standard limits, whichever is lower.
  • Additional Insurance: Customers may purchase additional insurance coverage for high-value items at checkout.
  • Exclusions: We are not liable for delays caused by force majeure events including natural disasters, war, strikes, customs delays, or government actions.
  • Damage Claims: Damage claims must be filed within 7 days of delivery with photographic evidence and original packaging.
  • Loss Claims: Loss claims must be filed within 30 days of expected delivery date.
  • Maximum Liability: Our maximum liability shall not exceed the declared value of the shipment or the amount paid for insurance, whichever is applicable.
  • Consequential Damages: We are not liable for consequential, indirect, or punitive damages including loss of business, profits, or data.

5. Delivery Terms

  • Delivery Times: Estimated delivery times are provided as guidelines only and are not guaranteed unless express guaranteed service is purchased.
  • Delivery Attempts: We make up to 3 delivery attempts before returning shipment to sender or holding at local facility.
  • Signature Requirements: Some shipments require signature upon delivery. Recipient must present valid identification.
  • Access Issues: Customer is responsible for ensuring safe and legal access to delivery location. Additional fees may apply for difficult access.
  • Customs Delays: International shipments may be delayed by customs inspection. Customer is responsible for all customs duties and documentation.
  • Undeliverable Packages: Packages undeliverable due to incorrect address, recipient unavailable, or customs issues will be returned to sender at sender's expense.

6. Customer Responsibilities

Customers agree to:

  • Provide accurate and complete sender and recipient information
  • Properly package items to prevent damage during transit
  • Accurately declare contents and value of shipments
  • Comply with all applicable laws and regulations
  • Pay all applicable fees, duties, and taxes
  • Make recipient available during delivery window or arrange alternative delivery
  • Report any issues or claims within specified timeframes
  • Maintain current contact information for notifications

7. Privacy and Data Protection

Pacific Direct Express is committed to protecting your privacy. Our collection, use, and disclosure of personal information is governed by our Privacy Policy. By using our services, you consent to:

  • Collection of personal information necessary for service delivery
  • Sharing of information with partner carriers and customs authorities as required
  • Use of tracking data for service improvement and analytics
  • Communication regarding shipments, promotions, and service updates

8. Limitation of Liability

To the maximum extent permitted by law, Pacific Direct Express shall not be liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, revenue, business, or data
  • Delays caused by circumstances beyond our reasonable control
  • Errors or omissions in tracking information
  • Customs delays, seizures, or confiscations
  • Damage caused by improper packaging by customer
  • Loss or damage to prohibited items

Our total aggregate liability for any claim shall not exceed the amount paid for the specific shipment giving rise to the claim.

9. Governing Law and Dispute Resolution

  • Governing Law: These terms shall be governed by and construed in accordance with the laws of the jurisdiction where Pacific Direct Express is registered.
  • Dispute Resolution: Any disputes shall first be attempted to be resolved through good faith negotiation.
  • Arbitration: If negotiation fails, disputes shall be resolved through binding arbitration in accordance with international arbitration rules.
  • Class Actions: Customers agree not to participate in class action lawsuits against Pacific Direct Express.
  • Jurisdiction: Courts in the registered jurisdiction shall have exclusive jurisdiction over any legal proceedings.

10. Modifications to Terms

Pacific Direct Express reserves the right to modify, amend, or update these Terms and Conditions at any time without prior notice. Changes become effective immediately upon posting to our website.
